Huntsman Cancer Foundation (“we,” “our,” or “us”) respects your privacy. This Privacy Notice explains the types of personal information we collect when you use our website at hope.huntsmancancer.org/give.huntsmancancer.org and related electronic resources (collectively, our “Platform”). You may use our website for obtaining information about the work that we do, for making donations to us, for coordinating fundraising activities, or for other activities that might be made possible on our Platform from time to time (“Services”). This Notice also describes how we use personal information, under what circumstances we may share it and with whom, and any rights and choices you may have.

Please read this Notice carefully to understand our policies and practices regarding your personal information and how we will process it. You can also click on the links below to easily navigate to a specific section.

  1. Personal Information We Collect
    1. Personal Information You Provide

      Personal information is any information that relates to an identified or identifiable individual. In many cases, the personal information you provide directly to us through our Services will be apparent from the context in which you provide the information, including:

      1. When you register for a Huntsman Heroes account, we collect your full name, date of birth, email address, address, organization name, and other related information such as account login credentials. If you register using a third-party application, such as your Facebook account, we may collect additional information that Facebook shares with us, such as your Facebook ID and other profile information.
      2. When you make a donation, we collect your full name and contact information, donation information such as amount and frequency, and payment and billing information.
      3. When you hold your own fundraiser, we collect your full name and contact information, campaign type, and any other information you choose to provide in the fields.
      4. When you sign up for our e-newsletter, we collect your email address.
      5. When you communicate with us through the Services or otherwise by email or phone, we collect information about your communication and any other information you provide in your response.

      You may also choose to submit personal information to us via other methods, including: (i) through social media or online forums; (ii) through participation in an offer, program, event, or promotion; or (iii) in connection with an actual or potential partnership with us.

    2. Information We Automatically Collect

      Our Services use cookies and similar tracking technologies. These technologies record information about you, including:

      1. Browser and device data, such as IP Address, device type, operating system and Internet browser type, screen resolution, operating system name and version, device manufacturer and model, language, plug-ins, add-ons and the language version of the Services you are visiting.
      2. Usage data, such as time spent on the Services, pages visited, links clicked, language preferences, and the pages that led or referred you to our Services. We also use Google Analytics on our Services to help us analyze your use of our Services and diagnose technical issues.   2. How We Use Personal Information

    We rely on a number of legal grounds to enable our use of your personal information. We use personal information to pursue our legitimate business interests, to enter into a business relationship with prospective partners and perform contractual obligations that we have with them, and to comply with our legal obligations. We also use personal information with your consent. More specifically, we use personal information in the following ways:

    • Provide you with our Services, including to respond to any inquiries from you, take steps to onboard new donors, process payments, and send service communications.
    • Provide you with the best service and improve and grow our Services, including using donor information and donation trends to created targeted outreach and messaging designed to increase engagement in our mission; as well as understanding the effectiveness of our marketing.
    • Help us improve and personalize the functionality of the Services.
    • Communicate with you regarding customer service matters, questions, and other various comments or feedback you may send to us.
    • Inform you about products, services, offers and events we offer or sponsor, and to provide news and other information that may be of interest to you.
    • Offer you the opportunity to participate in contests or surveys regarding the Services.
    • Protect against and prevent fraud, unauthorized transactions, and manage risk exposure.
    • Enforce our legal rights and agreements.
    • Comply with applicable legal requirements.

    We may aggregate and de-identify the personal information in our database and create reports that do not personally identify individuals.

  3. How We Disclose Personal Information

    We will share your personal information with third parties only as described in this Notice:

    • Affiliates, including University of Utah, University of Utah Health, and Huntsman Cancer Institute, in order to provide our Services, for collaboration to advance our charitable mission, and for administrative purposes. We share name, contact information, and the activity history of our donors and constituents with our affiliates.
    • Service providers and other third parties to perform functions on our behalf such as website hosting, payment processing, marketing automation, analytics, and site optimization. We require such service providers to contractually commit to protect the security and confidentiality of the personal information they process on our behalf.
    • Donor partners, in connection with our Services. For example, when we co-sponsor an event to raise donations, we may disclose registration information with our co-sponsor.
    • Comply with any court order, law, or legal process.
    • Enforce our agreements.
    • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, or users of the Services.

    We reserve the right to transfer your personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets. Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your personal information in a manner consistent with our Notice.

    Please be aware that if you disclose personal or other information through public forums, at an event, on online message boards, or in other public spaces, this information may be collected and used by others. We take no responsibility for the content, security, or confidentiality of any information posted on or conveyed in these public spaces.

  4. Your Rights and Choices
    1. Opting Out of Receiving Electronic Communications

      If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you other messages in connection with providing our Services.

    2. Your Ability to Access or Update Your Account Information

      To see or update your personal information, you may do one of the following:

    3. Your Ability to Delete Your Account

      If you would like to delete your account, you may do so by contacting us at [email protected]. Please note that even if you delete your account, we may still retain your personal information in certain circumstances, including if retaining your personal information is required for us to complete the transaction for which we collected the personal information or to provide a good or service that you requested, to detect security incidents, or to comply with our legal obligations.

    5. Your Data Protection Rights

      If you are located in the EEA or the UK, you have the following rights with respect to the personal information we process:

      • Right to Access. You have the right to request a copy of any information that we hold about you.
      • Right to Rectify. If you discover that the personal information we hold about you is incorrect or out of date, you may ask us to correct that information.
      • Right to be Forgotten/Cease Processing. You may ask us to delete the personal information we hold about you in certain circumstances. It may not be possible for us to delete all the personal information we hold about you where we have an ongoing relationship.
      • Right to Object to or Restrict Processing. You may object or ask us to restrict processing the personal information we hold about you in certain circumstances. It may not be possible for us to stop processing all the personal information we hold about you where we have an ongoing relationship.
      • Right to Withdraw Consent. Where we process your data on the basis that you have consented to such processing, you have the right to withdraw your consent at any time by unsubscribing or contacting us, as applicable.
      • Right to Portability. You may ask us to transfer your personal information to a third party in certain circumstances.
      • Right to Appoint an Individual to Exercise your Rights. If you choose to exercise any of your rights, you have the right to appoint someone else to exercise these rights on your behalf.
         
    6. How You Can Exercise Your Data Protection Rights

      If you would like to exercise any of your rights, please contact us at [email protected] or by a method described in the Contact Us section below. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your personal information. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. When you submit a request, we will verify your identity such as by verifying that the email address from which you send the request matches your email address that we have on file. Authentication based on a government-issued and valid identification document may be required. We will only use the personal information you provide to verify your identity or authority to make the request on behalf of someone else. If we are able to verify your identity immediately when you make the request, we will not maintain, acquire or process additional information in order to identify you for the purpose of responding to your request.

      If you feel that you have not received a satisfactory response from us, you may have the right under applicable laws to consult with the data protection authority in your country. If you are a resident of the EEA, you may direct your questions or complaints to the supervisory authority of the country you are located in, available here. If you are a resident of the UK, you may direct your questions or concerns to the UK Information Commissioner’s Office.

  5. Notice for California, Virginia, and Colorado Residents

    California, Virginia, and Colorado law provide their residents with rights to receive certain disclosures regarding the collection, use, and sharing of personal information, as well as rights to access, delete, and restrict the same of certain personal information we collect about them.

    1. Collection and Use of Personal Information

      For the purposes of this Notice for California, Virginia, and Colorado Residents, “personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

      Below we describe the categories of personal information we have collected about you in the last twelve (12) months as well as how we collect it and our purpose for collecting it. Some of the categories include very different types of information within the same category. As a result, how we use and how long we keep the information within each category will vary. Not all types of information within the same category will be collected or used for all the purposes listed.

    3. Sale of Personal Information and Right to Opt-out

      For the purposes of this Notice for California, Virginia, and Colorado Residents, “sale” or “sell” means disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration. While we do not disclose personal information to third parties in exchange for monetary compensation, we do disclose or make available personal information to third parties in order to receive certain services or benefits from them, such as in connection with cookies that third parties may have collected on our Services. If you have visited our Services or a website operated on behalf of us in the preceding 12 months, cookies and other metadata about you may have been obtained by our third parties for their commercial use, unless you have disabled or opted-out of the use of "cookies" when you visited the Services.

    4. Your Rights

      If you are a resident of the state of California, Virginia, or Colorado, you have the following rights with respect to your personal information:

      • The right to know or request that we disclose what personal information of yours we collect, use, disclose and sell, including:
        • the categories and specific pieces of personal information we have collected about you;
        • the categories of sources from which we collected the personal information;
        • the business or commercial purpose for which we collected the personal information;
        • the categories of third parties with whom we shared the personal information; and
        • the categories of personal information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed that information for a business purpose.
      • The right to request that we correct inaccuracies within the personal information we hold about you.
      • The right to request that we delete personal information we have collected in certain circumstances provided by law.
      • The right to opt-out of the “sale” of your personal information by us.
      • The right to obtain a copy of your personal information in a portable manner, if technically feasible.
      • The right not to receive discriminatory or differentiated treatment by us because you exercised any of these rights.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. When you submit a request, we will verify your identity such as by verifying that the email address from which you send the request matches your email address that we have on file. Authentication based on a government-issued and valid identification document may be required. We will only use the personal information you provide to verify your identity or authority to make the request on behalf of someone else. If you wish to authorize a third party to make a request on your behalf, you must provide a valid California power of attorney or comparable documentation of written permission from you and verification of your identity. Such power of attorney must meet the requirements of Probate Code sections 4000 to 4465.

      We will respond to a verified request for personal information within 45 days of receipt. If we require more time (up to 45 additional days), we will notify you of the reason and extension period by email. Any disclosures we provide will only cover the 12-month period preceding the verifiable request's receipt. The response will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

    5. California “Shine the Light” Law

      California residents additionally have the right to request information regarding third parties to whom we have disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes under California’s “Shine the Light” law (Cal. Civ. Code §1798.83). Personal information under this California law means “any information that when it was disclosed identified, described, or was able to be associated with an individual.” We do not disclose this type of personal information to third parties for their direct marketing purposes.   6. Cookie Policy

    Cookies are small text files that are stored in a computer’s browser directory. When you visit our Services, we may collect personal information from you automatically through cookies or similar tracking technologies (“cookies”). We also rely on partners to provide features of our Services using data about your use of the Services.

    1. How Do We Use Cookies?

      We use cookies and similar tracking technologies for the following purposes:

      • Services Operations. Enabling features that are necessary for providing you the Services, such as managing your login session, tracking content views, and remembering your preferences in order to continually improve it and better serve the needs of our users.
      • Security. Allowing us to maintain the security of our website and services by monitoring IP addresses and indicators of fraudulent use and attacks.
      • Device recognition. Allowing us to update/upgrade our website and services by monitoring type and version of device operating system.
      • Analytics. Allowing us to understand how our Services are being used, track site performance, and make improvements.
      • Social Media. Enabling the sharing of content from our Services through social networking and other sites. Facilitating account registration and login.

      Specifically, for analytics providers, we use Google Analytics which is a web analytics service offered by Google. Google Analytics uses the data collected to track and monitor the use of our Services. Google Analytics shares this data with other Google services. Google may use the collected data to contextualize and personalize the ads in its own advertising network.

      We do not currently use technology that recognizes “do not track” signals from your web browser.

    2. Can I Opt-out?

      You can opt-out of most cookies through your web browser’s settings, including by deleting or disabling cookies. You cannot disable or opt-out of cookies that are necessary to provide you with our Services. You can take a look at the help section of your web browser or follow the links below to understand your options regarding cookies. If you choose to disable cookies, some features of our Services may not operate as intended.

      To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on available at https://tools.google.com/dlpage/gaoptout. For more information on the privacy practices of Google, please visit the Google Privacy & Terms web page at https://policies.google.com/privacy.

      If you register for an account using your Facebook account, you can control the information we receive from Facebook by updating your privacy settings in your Facebook account. As a website user, you can also ask us to delete the information we’ve received from Facebook by contacting us at [email protected]. If you choose to delete such information, some features of our Services, such as your ability to log into your account, may not operate as intended.

  7. Data Security and Retention

    We have implemented measures intended to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Your personal information is only accessed by a limited number of personnel who need access to the information to perform their duties. There is an inherent risk involved in interacting with organizations on the internet. We cannot guarantee that the security measures we have in place to safeguard personal information will never be defeated or fail, or that such measures will always be effective. If you have reason to believe that your interaction with us is no longer secure (e.g., you feel that the security of your account has been compromised), please contact us immediately.

    We will retain your information for as long as your account is active or as needed for the purposes set out in this Notice. Even after we stop providing Services directly or indirectly to you, and even if you close your account, we may keep your personal information to comply with our legal and reporting obligations. In all cases where we keep data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law.

  8. International Data Transfers

    If you access our website or use our services from outside of the United States, it is necessary for us to transfer your information to the United States to provide you with services. Since the data protection laws of various countries differ, information transferred to the United States may not be subject to the same level of protection as the country in which you reside. For example, in the United States, officials, such as law enforcement, may be entitled to access your personal information. We take measures to comply with applicable data protection laws related to such transfer, and we rely on your consent to transfer data to the United States. To the extent you do not consent to data transfers to the United States, please do not provide us with your personal information or visit our website.

  9. Use by Minors

    The Services are not directed to minors, including those under the age of 16. If we learn we have collected or received personal information from a minor under the age of 16, we will delete that information. If any online service linked to our Services is not owned or controlled by us, or does not claim to be covered by this Notice, we are not responsible for it and/or it is not covered by this Notice.

    Our website may include links to our affiliates or other third parties. These linked sites may have personal information collection and use practices that differ from our practices. We encourage you to review the privacy policies, statements, or notices of these sites to understand their privacy practices before sharing information with them.

    We may amend this Notice from time-to-time. For material changes to this Notice, we will place a prominent notice on this website and/or send an email notification of the change.
